The ACT agreed to pay $16 million to California students with disabilities. This is the aftermath of the 2018 class-action federal lawsuit filed in California that alleged the ACT violated the Americans with Disabilities Act. The ACT did not admit guilt when it agreed to this payment. However, we’re pretty confident the ACT would not have voluntarily parted with the $16 million if it hadn’t flagged disability statuses for the colleges and excluded these same test takers from its Educational Opportunity Service recruitment program.
